Stamp duty is a state government tax levied on the transfer of immovable property. It is paid by the buyer and must be paid before or at the time of property registration. An unstamped or insufficiently stamped document is not legally enforceable in court. Rates vary by state — Kerala charges 8% (highest), Telangana charges 4% (lowest among metros).

Registration vs Stamp Duty

Stamp duty and registration charges are two separate fees. Stamp duty goes to the state government and is the larger amount (4-8% of property value). Registration fee goes to the Sub-Registrar's office and is typically 1% (sometimes capped at ₹30,000-2,00,000 depending on state). Both are paid together during property registration.

Women Buyer Concessions

Most Indian states offer a 1-2% stamp duty concession to women buyers. This is one of the most underutilised tax savings in Indian real estate. On a ₹75 lakh property, a 2% concession saves ₹1.5 lakhs.
